Terms of Use
Terms for FastDox Canada websites, demonstrations, debtor journeys and online platform services.
These Terms of Use (“Terms”) apply to websites, demonstrations, portals, digital journeys and other online services made available by FastDox (“FastDox”, “we”, “us” or “our”).
By accessing or using a FastDox website or service, you agree to these Terms. If you access FastDox on behalf of an organisation, you confirm that you are authorised to do so and, where applicable, to bind that organisation.
1. About FastDox
FastDox provides software and digital workflow technology for organisations including debt and insolvency firms, Licensed Insolvency Trustees, financial-services organisations and professional-services businesses.
Depending on customer configuration, the platform may support digital enquiries, debtor onboarding, financial information collection, document and evidence management, AI-assisted document processing, banking analysis, workflow and task management, appointments, professional review, document generation, electronic acceptance and signing, reporting, integrations and downstream data handoff.
FastDox is a technology provider. FastDox is not a Licensed Insolvency Trustee and does not itself provide insolvency, legal, accounting, investment or regulated financial advice through the website or platform.
2. Customer agreements
These Terms govern general access to our websites and online services. Organisations purchasing or subscribing to FastDox may also enter into an Order Form, Software-as-a-Service Agreement, Master Services Agreement, Data Processing Agreement, implementation agreement or other commercial agreement.
If there is a conflict between these Terms and a signed commercial agreement relating to use of FastDox, the signed commercial agreement controls to the extent of that conflict.
3. Debtor and client journeys
If you are using FastDox because an organisation sent you a link, invited you to a portal or asked you to complete a journey, that organisation is responsible for the professional or regulated service it is providing. FastDox supplies the underlying technology.
Information you provide may be made available to authorised personnel at that organisation, and separate terms or privacy notices from that organisation may also apply. Questions about an insolvency matter, financial recommendation, proposal or other professional decision should be directed to the organisation providing the service to you.
4. Licensed Insolvency Trustee decisions
FastDox may assist in collecting, organising, analysing and presenting information for insolvency workflows. However, FastDox does not act as an LIT, does not determine whether a person should file a bankruptcy or consumer proposal, and does not replace the professional judgement or statutory responsibilities of an LIT.
Calculations, comparisons, summaries and observations presented by the platform are tools to support workflow and professional review.
5. AI-assisted functionality
FastDox may provide AI-assisted features for conversational information gathering, document classification, data extraction, financial and banking analysis, summarisation, comparison of information, identification of possible discrepancies and preparation of information for human review.
AI-generated or AI-assisted outputs may be incomplete, inaccurate or require interpretation. They must not be treated as professional advice unless appropriately reviewed and provided by a qualified person acting in that professional capacity. FastDox customers remain responsible for determining where human review is required.
6. Declared, observed and reviewed information
FastDox may distinguish between information from different sources. Information entered by a debtor may be recorded as declared information; document or banking information may be recorded as observed information; and information confirmed by authorised staff may be recorded as reviewed information.
An observed difference does not necessarily mean previously provided information is wrong. The platform may present differences for further review rather than automatically replacing reviewed information.
7. Demonstrations and simulated functionality
FastDox may provide demonstration, sample, preview or simulated environments. These may contain fictitious individuals, synthetic financial information, sample documents, simulated AI analysis, simulated banking data, simulated integrations, simulated electronic signing and simulated downstream handoffs.
Demo content is provided solely to demonstrate functionality and must not be treated as real client information, a live provider response, an actual regulatory filing, professional advice or confirmation that a particular third-party integration is active in production.
8. Third-party systems
FastDox may demonstrate or provide integrations with third-party systems, including insolvency administration, case-management, banking, communications, identity, electronic-signature and other platforms. Third-party names and trademarks belong to their respective owners.
Unless expressly confirmed in writing, a demonstration of a handoff or integration does not mean a production integration has been activated, a third party endorses FastDox, a regulatory filing has occurred or information has been submitted to an external authority.
9. Accounts and security
Certain FastDox services require an account. You are responsible for providing accurate account information, keeping login details confidential, using reasonable security practices, promptly reporting suspected unauthorised access and ensuring the platform is used only by authorised individuals.
FastDox may suspend access where reasonably necessary to protect security, investigate misuse or comply with legal obligations.
10. Acceptable use
You must not use FastDox to break applicable law, infringe another person’s rights, access information without authorisation, upload malicious software, interfere with platform security, circumvent access controls, impersonate another person, overload or disrupt the service, or reverse engineer the platform except where restriction is prohibited by law.
11. Information you provide
You are responsible for information and files that you submit to FastDox and confirm that you are authorised to provide them. You should not upload information that is unnecessary for the relevant process. Organisations using FastDox are responsible for ensuring their collection and use of personal information is lawful.
12. Uploaded documents
FastDox may allow users to upload documents and supporting evidence. Uploaded files may be processed by automated or AI-assisted tools. Automated processing should not be assumed to be error-free, and important information should be reviewed where appropriate.
13. Banking information
Banking features may process uploaded statements or information received through an authorised provider. Analysis may identify or estimate transaction categories, income, expenditure, recurring payments, creditor payments and other financial patterns. Such analysis is intended to assist review and should not be treated as independently verified unless the workflow confirms review.
14. Electronic acceptance and signing
FastDox may support electronic acceptance and electronic signatures. The platform may separately record professional approval, debtor or client acceptance, signature status and timestamps. The legal effect of a particular electronic signature or acceptance depends on the document, applicable law, configured process and parties involved.
15. Appointments
FastDox may allow users to view availability and book appointments. Availability may depend on customer configuration, scheduling rules, staff availability and third-party calendar services. Booking an appointment does not guarantee any particular professional outcome.
16. Communications
FastDox may facilitate journey invitations, reminders, document requests, appointment confirmations, security notices, account messages and workflow communications. Necessary service and transactional communications may be sent to support the relevant journey or customer relationship.
17. Intellectual property
FastDox and its licensors own rights in the FastDox platform, including software, interfaces, designs, databases, workflows, documentation, branding, graphics and website content. Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, sublicense, publicly display, reverse engineer or create derivative works from FastDox materials.
18. Customer and user content
As between FastDox and the party providing information, ownership of uploaded customer or user content remains with that party or the person otherwise entitled to it. You grant FastDox the rights reasonably necessary to host, process, transmit, display, analyse, back up and otherwise handle that content solely to provide, secure and support the service as permitted by applicable agreements and law.
Nothing in these Terms transfers ownership of customer records to FastDox.
19. Confidentiality
Information submitted through customer environments may be confidential. Users must not disclose information obtained through FastDox unless authorised to do so. Additional confidentiality obligations may apply under customer agreements or professional rules.
20. Privacy
Our handling of personal information is described in the FastDox Canada Privacy Policy. Where you use FastDox through another organisation, that organisation’s privacy notice may also apply.
21. Third-party services
FastDox may integrate with or link to third-party services. FastDox is not responsible for the independent operation, availability, security, content or terms of those services. Separate third-party terms may apply.
22. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. FastDox may maintain, update, improve, replace, modify or discontinue features where reasonably necessary. Contracted service commitments, if any, are set out in the applicable commercial agreement or service-level agreement.
23. Beta, preview and demonstration features
Features labelled beta, preview, pilot, demonstration, simulation or experimental may be incomplete, change without notice or operate differently from generally available production functionality. They should not be relied upon for production or regulated activity unless FastDox has expressly approved that use.
24. No professional advice
Information on FastDox websites and non-reviewed platform outputs are provided for general information and workflow support. They do not constitute legal, accounting, investment, credit-counselling or insolvency advice, a recommendation to file a consumer proposal or bankruptcy, or another regulated professional opinion.
25. No guarantee of outcome
FastDox does not guarantee eligibility for a consumer proposal, acceptance of a proposal, creditor approval, court or regulatory approval, debt reduction, completion of an insolvency process, or any particular financial, legal or professional outcome.
26. Disclaimer
To the maximum extent permitted by applicable law, FastDox websites, free demonstrations and informational content are provided on an “as available” basis. FastDox does not warrant that all content will always be accurate, automated extraction will be error-free, AI output will always be correct, all third-party integrations will always be available or demonstrations exactly reflect a customer’s production configuration.
Nothing in these Terms excludes warranties, consumer rights or other protections that cannot lawfully be excluded.
27. Limitation of liability
To the maximum extent permitted by applicable law, FastDox will not be liable under these website Terms for indirect, incidental, special or consequential loss arising from reliance on free website content or demonstrations. For paying customers, liability relating to the FastDox subscription or professional services is governed by the applicable commercial agreement.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
28. Suspension and termination
FastDox may suspend or terminate access where reasonably necessary because of material breach, security risk, suspected fraud, unlawful use, non-payment under an applicable customer agreement, or legal or regulatory requirements. For contracted customers, termination rights are governed primarily by the relevant commercial agreement.
29. Governing law
These general website Terms are subject to applicable Canadian law and any mandatory laws that apply to the relevant user or service. Where a signed commercial agreement applies, the governing-law provisions in that agreement take precedence.
This clause does not remove or limit mandatory rights or protections available under applicable Canadian federal or provincial law. For FastDox customers, the governing-law provision in a signed commercial agreement takes precedence.
30. Changes to these Terms
We may update these Terms from time to time. Where a material change affects contracted use of FastDox, additional notice may be provided where required.
31. Contact
Questions about these Terms may be submitted through the FastDox website contact page. Privacy enquiries are handled in accordance with our Privacy Policy.
